The U.S. Department of Labor on Thursday, March 7, 2019, issued its proposed rule raising the floor for white-collar exemptions from $23,000 to $679 per week or $35,308, annually.
In the previous Obama administration, the proposed threshold for qualifying for the white-collar exemption was $47,000. This new proposal also calls for periodic updates to the threshold salary every four years. The expected implementation of the new salary requirement is January 2020.
It is probable that this new salary requirement will actually go into effect, unlike Obama's proposal, since it is unlikely that it will be challenged by Congress, (unless by the Democratic-controlled House) or in the Courts.
More information about the proposed rule is available here.
We will keep you apprised if and when this new proposal becomes final. If you have any questions or wish to discuss, please contact any member of GrayRobinson's labor and employment team.
